He is also recognized for his work in software product protection through copyright and patent law and for combating unfair competitive practices in software by hardware manufacturers. Does every software-supported invention – even a shopping cart function in an online store – have to be patented, as required by law in the United States? Since 1973, the European Union has had a patent convention (PC) that declares software in itself as ineligible of receiving a patent. To enable patenting of computer-implemented inventions, the European Commission suggested guidelines during the past few years. But the European Parliament rejected the guidelines in a majority vote on July 6, 2005. Nikolaus Forgó, professor for IT law at the University of Hanover, explains how sensible he finds it to patent innovative software.
